These terms govern your use of pineconesites.com and any services you engage Pinecone Sites to provide. By using the site or hiring us, you agree to them.
1. Who we are
Pinecone Sites is a New Jersey web design studio that builds and maintains websites for local businesses, and provides related services such as search visibility (SEO) and Google Ads setup and reporting for the sites we build.
2. Our services and quotes
We describe our services and pricing on the site. Specific scope, deliverables, and fees for your project are set out in the proposal or agreement we provide before work begins. Where a separate written agreement conflicts with these terms, that agreement controls.
3. Fees and payment
Our standard model is a one-time fee to design and launch your site, plus a monthly fee for hosting, domain, and ongoing updates, as described on the site or in your proposal. Monthly services continue until cancelled. Fees are non-refundable except where required by law or stated otherwise in your agreement.
4. Your responsibilities
You're responsible for the accuracy and rights to any content (text, images, logos, and other materials) you give us to use, and you confirm you have permission to use it. You'll provide timely access, feedback, and approvals so we can do the work.
5. Ownership
On full payment for a project, you own the final website content and design deliverables we create specifically for you. We may retain rights to our underlying tools, templates, and know-how, and may show completed work in our portfolio unless you ask us not to.
6. Third-party services
Our work may rely on third-party platforms (for example hosting, email delivery, analytics, and advertising services). Your use of those platforms is subject to their terms, and we aren't responsible for their availability or actions.
7. Advertising services
Where we set up or manage Google Ads or similar for your business, we do so on your behalf and with your authorization. Advertising results depend on many factors outside our control, and we don't guarantee specific rankings, traffic, clicks, or sales.
8. Disclaimers
The site and our services are provided "as is." We do our best work, but we don't warrant that the site will be uninterrupted or error-free, or that any particular business outcome will result.
9. Limitation of liability
To the extent permitted by law, our total liability arising from the site or our services is limited to the amount you paid us for the services giving rise to the claim. We aren't liable for indirect or consequential losses.
10. Termination
You can stop monthly services at any time with notice as described in your agreement. We may suspend or end services for non-payment or misuse.
11. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
12. Changes
We may update these terms; the "last updated" date reflects the current version.
